DECISION

1. The Committee, having considered the application and relevant documentation, is satisfied that:

a) the application complies with the requirements of the Act, Act 34 of 1995;

b) the act, omission or offence to which the application relates are acts associated with a political objective committed in the course of the conflicts of the past;

c) that the relevant facts relating to the particular offence have been disclosed.

2. Amnesty is therefore GRANTED in respect of the following offences.

a) Contravention of Section 54(3)a of Act 74 of 1982 in that on 2 February 1994 at or near Boomstreet, and/or Palmietfontein and/or Abramson Street, Flamwood, Klerksdorp the applicant prepared explosive devices and caused it to explode, causing damage to the property of the associations and persons mentioned in the charge sheet in case no. A238/94 in the Regional Court at Klerksdorp.

b) Contravention of Section 6(1) of Act 26 of 1956 in that the applicant was in illegal possession of explosives as reflected under count 2 of the aforementioned case.

c) Contravention of Section 54(3)(c) of Act 74 of 1982 in that the applicant on 21 January 1994 endangered the rendering of public services as described in count 4 of the aforementioned indictment at or near the Nootgedacht Smallholdings between Klerksdorp and Orkney and/or Palmietfontein and/or Abramson Street, Klerksdorp.

d) Any other offence or delict directly linked to the acts described above excluding any gross violation of human rights as defined in Act 34 of 1995.
